Terms of Service

1. Acceptance of Terms

By accessing or using Purist Journal, you agree to be bound by these Terms of Service, including any future updates. If you do not agree to these Terms, please do not use the application.

These Terms apply to all users of Purist Journal worldwide, including users of the Free Tier and Purist+ subscribers.

2. Account Creation & Authentication

To access certain features, including cloud synchronization, you must create an account using Google OAuth. By creating an account, you agree to the following:

• You are responsible for maintaining the security of your account and for all activities that occur under it.
• Each account is for individual personal use only. You may not share your account credentials with others.
• You must provide accurate information when creating your account and keep it up to date.
• Your ability to access Purist Journal may depend on your Google account remaining active. We are not responsible for loss of access resulting from changes to, or termination of, your Google account.
• If you suspect unauthorized access to your account, contact us immediately at mostafaabdrabu@gmail.com.

3. User Data Ownership

You own 100% of the content you create in Purist Journal. We do not claim any ownership rights over your journal entries, tasks, habits, or any other content you create.

You grant us a limited, non-exclusive, royalty-free license to store, sync, and transmit your content solely to provide the service to you (for example, syncing across your devices). This license ends when you delete your data or close your account.

We do not use your journal entries, tasks, habits, or any other personal content to train machine learning or AI models.

4. Subscriptions & Billing

Purist+ is a subscription-based premium tier of Purist Journal. The following terms apply to all paid subscriptions:

• Billing: All billing is handled by Lemon Squeezy, our Merchant of Record. By subscribing, you also agree to Lemon Squeezy's terms and policies.
• Automatic renewal: Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date.
• Pricing: Current pricing is displayed in the app and on our website. We reserve the right to change pricing with reasonable advance notice.
• Price changes: If we increase the price of Purist+, we will notify you in advance and you will have the opportunity to cancel before the new price takes effect.
• Cancellation: You can cancel your subscription at any time through the in-app Account Settings. Cancellation takes effect at the end of your current billing period. You will retain access to Purist+ features until that date.
• After cancellation: When your subscription ends, your account will revert to the Free Tier. Your previously synced data will remain accessible for a limited period, after which it may be deleted. Please export your data before cancelling if you wish to retain it.
• Failed payments: If a payment fails, your subscription may be paused or downgraded to the Free Tier. We will attempt to notify you by email.
• Refunds: Our refund policy is described on our Refund Policy page. As Lemon Squeezy acts as our Merchant of Record, refund requests may be handled directly by them in accordance with their policies.

5. Fair Usage & Conduct

You agree to use Purist Journal for its intended purpose as a personal productivity and journaling tool. You may not use the service to:

• Engage in any illegal activities or store content that violates any applicable laws.
• Store, distribute, or transmit content that is unlawful, harmful, abusive, defamatory, infringing, or otherwise objectionable.
• Attempt to reverse-engineer, decompile, or tamper with any part of the application.
• Use automated tools, scripts, or bots to access or interact with the service in a way inconsistent with normal personal use.

We reserve the right to contact you or limit your access if we detect usage patterns that appear automated, bulk, or inconsistent with personal journaling use.

6. Termination

By us: We reserve the right to suspend or terminate your account if you violate these Terms of Service. Where reasonably practicable, we will give you advance notice before terminating your account, unless the violation is severe or we are legally required to act immediately. Upon termination, your access to synced data will cease. We may retain certain information as required by law or for legitimate business purposes.

By you: You may stop using the service at any time and delete your data through the application settings. You can also request account deletion by contacting us at mostafaabdrabu@gmail.com.

We recommend exporting your data before closing your account or before termination takes effect.

7. Intellectual Property

The Purist Journal name, logo, design, code, and all related materials are the intellectual property of the operator of Purist Journal and are protected by applicable copyright, trademark, and other intellectual property laws.

You are granted a limited, non-transferable, non-exclusive license to use the application for personal, non-commercial purposes in accordance with these Terms. You may not copy, modify, distribute, sell, or create derivative works from any part of Purist Journal without our prior written consent.

8. Disclaimer of Warranties

Purist Journal is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that:

• The service will be uninterrupted, error-free, or completely secure.
• Any errors or defects will be corrected.
• The service or its servers are free of viruses or other harmful components.

We strongly recommend that you maintain your own backups of important data, particularly if you are on the Free Tier where data is stored only on your device.

9. Limitation of Liability

To the maximum extent permitted by applicable law, Purist Journal and its operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of revenue, or loss of profits, arising from your use of or inability to use the service.

Our total liability to you for any claim arising out of or relating to these Terms or the service shall not exceed the total amount you paid us in the twelve (12) months preceding the claim, or $10 USD, whichever is greater.

Some jurisdictions do not allow the exclusion or limitation of certain damages. If you are a consumer in such a jurisdiction, some of the above limitations may not apply to you, and your statutory rights remain unaffected.

10. Governing Law & Jurisdiction

These Terms of Service are governed by and construed in accordance with the laws of the jurisdiction where the operator of Purist Journal is domiciled, without regard to conflict of law principles.

Before bringing any formal legal claim, you agree to contact us at mostafaabdrabu@gmail.com to attempt to resolve the dispute informally. We will make a good-faith effort to resolve any issues within 30 days.

If a dispute cannot be resolved informally, it shall be submitted to the exclusive jurisdiction of the competent courts of the operator's domicile.

Consumer rights (EU/UK users): If you are a consumer located in the European Union or United Kingdom, nothing in these Terms affects your rights under the mandatory consumer protection laws of your country of residence. You may also have the right to bring proceedings in the courts of your country of residence.

11. Age Restriction

By using Purist Journal, you represent and warrant that you are at least 16 years of age. If you are under 16, you may not create an account or use our cloud-synchronized features (Purist+).

12. Indemnification

You agree to indemnify, defend, and hold harmless Purist Journal and its operator from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:

• Your use of the service in violation of these Terms.
• Your content or any content you submit to the service.
• Your violation of any applicable law or the rights of a third party.

13. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable under applicable law, that provision will be modified to the minimum extent necessary to make it enforceable, or removed if modification is not possible. The remaining provisions of these Terms will continue in full force and effect.

14. Entire Agreement

These Terms of Service, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Purist Journal regarding your use of the service, and supersede any prior agreements or understandings on that subject.

15. Changes to These Terms

We may update these Terms of Service from time to time. When we make material changes, we will update the "Last updated" date at the top and notify you via the app or by email at least 14 days before the changes take effect. Your continued use of the service after the effective date means you accept the updated Terms.
